Adequate Public Facilities Ordinances

-- A survey by George Edwards

Click here to view information on national experience with Adequate Public Facilities Ordinances (APFOs) and, specifically, in Maryland. Scroll down to read the overall country wide discussion in the Introduction. Note that APFOs have also been adopted in New York (1969), California, Washington and Florida -- in Maryland since 1978 including schools and roads in all 13 of the counties with APFOs and ten including water and sewer; Baltimore County includes storm water and recreation and Prince George's County, police/fire/rescue. All 12 of Maryland's municipalities with APFOs include schools. Click here for more related information from the smart growth perspective.

I stress the inclusion of schools in the Maryland APFOs, because of the, to me baffling, omission of schools in the "model" APFO prepared by SCDHEC for South Carolina. To view this "model" click here and scroll down. This proposed APFO requires that localities implement a capital facilities plan and that they must link the capital improvement program with a comprehensive land use plan.

Click here to view Adequate Public Facilities Ordinances in North Carolina: A Legal Review.  Even though this is a North Carolina review, at least some of it obviously involves legal concerns pertinent to South Carolina.

Google "Adequate Public Facilities Ordinance" and "Adequate Public Facilities Ordinance South Carolina" for further information. Click here to see the extent of Horry County's need for an Adequate Public Facilities Ordinance.
